Terms of Service

Short version: You bring your brand and prompts. We bring the engines and reporting. You own your data; we own what we built. Either side can leave with 30 days' notice. Liability caps at fees paid in the prior 12 months.

By creating a Visiby account or using the service, you agree to these Terms and the Privacy Notice. If signing for an organisation, you confirm authority to bind it.

Section 1

Acceptable use

Use Visiby to monitor how AI engines describe your brand and surface recommendations. Do not:

✕Scrape, reverse-engineer, or attempt to break into the service.

✕Resell or sublicence Visiby without a written reseller agreement.

✕Use the service for spam, harassment, defamation, or anything unlawful.

✕Exceed published rate limits without prior approval.

Violations may result in suspension. Repeat or severe breaches end the contract immediately.

Section 2

Your data & IP

Everything you configure or generate inside Visiby — keywords, prompts, exports — is your data. You grant us a limited licence to host and process it solely to provide the service. That licence ends when you delete your data or close your account.

We will never train AI models (ours or anyone else's) on your data, or read your prompts unless you open a support ticket requiring it.

Visiby — the code, dashboards, methodology, brand, and V mark — remains the property of FNA Technology LLP You receive a limited, revocable licence to use the service while your subscription is active.

Section 3

Billing

Pricing

Listed in USD, billed annually unless agreed otherwise. Taxes added at checkout.

Renewal

Auto-renews unless cancelled 30+ days before renewal. Reminders at 60 and 14 days out.

Refunds

Full refund within 30 days of purchase. After that, at our discretion for documented failures.

Late payment

1.5% per month interest. Access suspended after 14 days' delinquency with notice.

Price changes

60 days' notice before renewal. Mid-term prices are locked.

Section 4

Liability

Liability cap: Each party's aggregate liability is limited to fees paid in the prior 12 months. No indirect, consequential, or punitive damages — regardless of theory.

Exceptions: payment obligations, IP or confidentiality breaches, and liability that cannot be limited by law (gross negligence, wilful misconduct).

Section 5

Termination

For convenience

Either party can terminate with 30 days' written notice. We'll refund unused annual time.

For cause

Immediate termination on material breach uncured after 30 days, or on any acceptable-use violation.

After termination

Export your data within 30 days. After that it's deleted, except what we're legally required to retain.
